This is the Privacy Policy of Elgo Irrigation Ltd., Company Reg. No. 520040825 (hereinafter “Elgo”, the “Company”, “we”). Elgo operates a website for the sale of irrigation products on the site (the “Products”) and/or services related to the Products at www.omer-gard.co.il (the “Website”, the “Services”).
In this Privacy Policy, we will outline our data collection practices when using the Website, including the types of information collected, the methods by which information is collected, the uses made of the information, and your rights regarding the information. Therefore, we recommend reading the terms of this Privacy Policy carefully before using the Services and the Website. This document is drafted in the masculine gender for convenience purposes only.

1. General
1.1. The collection and processing of information are carried out in accordance with the provisions of the Protection of Privacy Law, 5741-1981 (hereinafter the “Law”), other laws applicable to us, and this Privacy Policy.
1.2. This Privacy Policy applies to information that personally identifies or may personally identify you, and constitutes an integral part of the Terms of Use. All definitions and terms in this Privacy Policy shall have the meanings ascribed to them in the Terms of Use, unless the context requires otherwise. This Privacy Policy applies to any use of the Website and the Services.
1.3. Elgo reserves the right to update or modify this Privacy Policy from time to time, as needed and at Elgo’s sole discretion, without any obligation to provide prior and/or retroactive notice.  If such changes and/or updates are made, they will take effect immediately upon posting the updated Privacy Policy on the Website. The date of the last revision will be reflected under the heading “Last updated”. If Elgo makes changes that, in its discretion, may materially affect your rights, Elgo will take reasonable measures to notify you via the Website.
1.4. This Privacy Policy is drafted in the masculine gender for convenience, but is equally addressed to all genders.

2. Consent
2.1. Under privacy laws, you are under no legal obligation to provide us with information and you do so of your own free will; however, if you choose not to provide us with information, you may be prevented from using certain parts of the Website. When using the Website, you must provide true, reliable, and accurate information.
2.2. Your use of the Website or providing details in any other manner shall be deemed your express consent to this Policy. If you do not agree to the terms of the Privacy Policy, in whole or in part, do not provide any information to the Company through the Website, or at all. 
2.3. If and to the extent that you provide personal information of or on behalf of any third party, you declare that you have obtained all necessary consents required by law from that third party, and that the use made of such personal information by the Company in accordance with this Privacy Policy will not infringe upon the privacy of that third party and/or any other rights. 

3. Types of Information We Collect
We collect and process various types of personal information when using the Services, including:
3.1. Contact Us – If you choose to contact us or request that we contact you, you will be required to provide us with your contact details, including name, email address, telephone number, and any information you choose to provide voluntarily through these means. Please do not provide us with information that is not necessary to receive information about our services or to purchase our services and products.
3.2. Registration – If you choose to register for the Website, you will be asked to provide us with the following details: email address and a password selection.
3.3. Information regarding purchases made on the Website – When purchasing products on the Website, you will be required to provide us with personal details for the order, including contact details and a shipping address or details of a nearby store for self-pickup, as well as payment details, credit card number and validity. In addition, we will retain information regarding transactions you have made, including purchased products and purchase history, at our discretion.
3.4. Information collected by technological tools – In addition to the above, we will collect data via cookies and various analytical tools regarding your browsing habits, such as IP address or device identifier (Device ID), duration of visit to the Website, etc. For more information about these tools, see our Cookie Policy.
3.5. Job applicant information – To the extent that you are interested in a position published by us, you may submit a curriculum vitae (CV) via the Website. We may receive information from you regarding education, professional experience, and contact details. Please do not provide us with information that is not necessary for your screening and placement.

4. Uses of Information
4.1. The collected information will be used primarily to provide our Services, comply with statutory requirements, and protect our legitimate interests.
4.2. Additional uses of the information may include, for example: (1) Contacting you. (2) Improving the user experience on the Website. (3) More accurate advertising to users. (4) Managing, monitoring, and improving the Services on the Website. (5) Customizing our Services to you. (14) Enriching our Website content through cookies and automatic data collection on the Website. (15) Identifying you as a registered user on the Website, verifying your identity when logging in, and providing you with personalized access to services and content available to registered users.
4.3. Anonymization and pseudonymization – We may convert identifiable information into anonymous or pseudonymized information to improve our services, develop and upgrade the Website, ensure information security, and perform advanced statistical processing for Elgo’s market research and surveys. We may share statistical reports with third parties for various purposes, but only after taking measures that would make it difficult to identify you with reasonable effort (such as transferring aggregated data regarding a group of customers).
4.4. Advertisements (including personalized advertisements) – Insofar as you have registered on the Website or otherwise approved the receipt of marketing mail and newsletters, the information will also be used by us and/or our representatives to send advertisements and mailings, including personalized ones, via email, SMS, social networks, and more. This consent constitutes consent to receive marketing messages under the Communications Law (Telecommunications and Broadcasting), 5742-1982.
You may request to be removed from the personalized mailing list by submitting a written request to the email address internet@elgo.co.il .
You may request to be removed from the mailing list for other advertisements sent to you via email and SMS by submitting a written request to the email address  info@omer-gard.co.il or in the manner specified in the advertising message itself.
Notwithstanding the above, we may continue to send you notices that the law does not require us to remove or that the law permits or requires us to send, such as order confirmations or notices regarding product shipments.
4.5. From time to time, you may request that we delete additional information if it is not required by us for day-to-day operations, compliance with statutory requirements, defense against legal claims, or other legitimate interests of ours, subject to the provisions of the law.

5. Transfer of Information to Third Parties
5.1. Information about you may be transferred to third parties abroad for the needs and purposes described above. These countries may sometimes provide less privacy protection than that provided under the laws of the State of Israel. By using the Website, you give your informed consent to the transfer of personal information and waive any claim and/or contention and/or demand against the Company on this matter.
5.2. We will transfer information to our vendors or subcontractors who provide services for us (such as hosting and cloud providers, IT, customer service, maintenance and support, and various outsourced services).
5.3. We will transfer your personal information to the courier companies we work with in order to deliver the products you purchased to you.
5.4. To the external payment processing provider with which the Company works.
5.5. In the event that the Company participates in content activities with a third party, or upon the purchase of joint products and services of the Company and a third party. In these cases, the information required by our business partners will be provided to them for the purpose of managing the relevant content activity, maintaining contact with you if necessary, and providing the joint services and/or products purchased by you within the framework of this activity.
5.6. We may share information about you with our affiliated companies for the purposes of use in this Policy and in accordance with the law, for the provision of Services, including risk management for us and our affiliated companies.
5.7. We may share information collected from you and/or regarding you pursuant to a legal obligation or authority, in accordance with the instructions of a competent authority or a court order, as well as due to a dispute, claim, lawsuit, demand, and/or legal proceedings conducted between you and/or anyone on your behalf and Elgo and/or anyone on its behalf.
5.8. We may transfer information to a third party when we believe it is necessary to prevent serious harm to Elgo and/or anyone on its behalf, and/or to the property and/or person of the user and/or third parties, or to prevent other serious injury and/or harm at our discretion.
5.9. Subject to the provisions of the law, Elgo may transfer all information about you to a third party as part of a transfer or sale of its business (in whole or in part) and/or restructuring, merger, joint ventures, and other transactions related to its business (including in the context of negotiations for such transactions) and for the purpose of the continued provision of Services by the third party. In these cases, the transfer of information will be subject to the recipient’s undertaking to use the information in accordance with the terms applicable to us.
5.10. Elgo may provide statistical information to third parties, including advertisers, subject to the terms of this Policy. Statistical information provided to third parties will not personally identify you and will be used, among other things, to improve, enrich, or modify the services and content offered by us or by the third party. Nothing in the foregoing derogates from our right to transfer non-personal information to third parties that does not directly identify you.
5.11. Without derogating from any of the above, Elgo shall be entitled to transfer non-identifiable or anonymous, aggregate, or statistical information to third parties without limitation, for any purpose whatsoever, including to improve, enrich, diagnose, repair, or modify our Website and Services and products and services offered by third parties.
5.12. Subject to the provisions below, the transfer of your personal information to third parties will be limited solely to the purposes enumerated in this Policy and only to the extent and degree required at the Company’s discretion. The Company will make reasonable efforts to ensure that recipients of the information are subject to confidentiality and information security obligations with respect to the information, in accordance with the law.

6. Information Security
6.1. Elgo makes every effort to protect the confidentiality of the information collected by it, while taking appropriate and acceptable information security measures in accordance with the provisions of law applicable to us. Elgo uses suitable security technologies to prevent intrusion into the platforms through which the Services are provided and to prevent potential harm to user privacy, and reviews these measures from time to time. However, Elgo cannot guarantee that there will be no disruption to the Services or that there will be no risk of data intrusion at all. Elgo will not be liable for damage caused as a result of such intrusion or transfer to third parties, provided that it has taken reasonable information security measures.
6.2. You are responsible for the use of your personal identification details, even if done without your consent. The responsibility to take information security measures also applies to you, for example:
6.2.1. Do not disclose login credentials to others (e.g., via email), to protect against online fraud (“phishing”).
6.2.2. Ensure that the contact details you provided to us (including telephone number and email address) are correct.  
6.2.3. Use anti-virus software, anti-intrusion protection, and similar tools on your terminal equipment from which you browse the Website. 
6.2.4. Keep software updated, download only from official websites, avoid using public computers or public Wi-Fi networks, and refrain from sharing sensitive information on social networks.
6.2.5. Use security measures for the terminal device from which you browse the Website, such as a password or biometric identification.
6.2.6. Match the method of communicating with us to its content. For example, if you do not use encryption and secure electronic signature mechanisms, you should contact us through means other than email if it concerns a sensitive matter regarding you.

7. Your Rights
7.1. Generally, your personal information or information about you will be retained by the Company for the period necessary for the Company to provide the services requested by you, as applicable, and as long as the Company has a legitimate need or a legal or other obligation to retain it under any law. Anonymous information will be retained in the Company’s information systems without time limit (as long as it is not prohibited by any law).
7.2. Under the Protection of Privacy Law, 5741-1981, you are entitled to review information about you held in the Company’s databases and even request that the Company correct this information if it is incorrect, incomplete, or inaccurate. This right can be exercised, and any questions and/or clarifications regarding this Policy may be addressed, as detailed in the “Contact Us” section below.
7.3. In the event of a request to delete information, information required by Elgo to conduct its business, including documentation of actions you performed in connection with the Services or defending against legal proceedings, will continue to be retained by us according to law, but will no longer be used to contact you via direct mail.
7.4. Furthermore, as detailed in this Privacy Policy and the Terms of Use, for the purpose of providing the Services, Elgo shares information with third parties; therefore, you hereby acknowledge and agree that, even if you ask us to update or delete information about you, we will not be able to update or delete information that has been transferred to third parties for the purpose of providing the Services and which is held by those third parties in accordance with their terms.
